Drum Circle Rewards Terms and Conditions

1. The Service

Drum Circle Rewards allows participating customers to identify their loyalty accounts, accumulate points from eligible purchases, view available rewards, and redeem rewards under the applicable loyalty program rules.

2. Eligibility and Accounts

Users must provide accurate information and are responsible for maintaining control of the telephone number or other identifier associated with their loyalty account. Accounts may not be sold, transferred, shared, or used for fraudulent purposes.

3. Loyalty Points and Rewards

Under the current eYrthBeat loyalty program, eligible purchases generally earn 100 points for each dollar spent, and 15,000 points may qualify for a $10 reward. Current earning and redemption rules displayed by the program control if they differ from this summary.

• Points and rewards have no cash value.
• Points are not transferable between customers.
• Points may not be purchased, sold, exchanged, or bartered.
• Taxes, tips, fees, gift-card purchases, refunded items, and certain excluded products may not earn points.
• Returns, refunds, chargebacks, corrections, or fraudulent transactions may result in points being reversed.
• Rewards may be subject to expiration, purchase requirements, exclusions, and redemption limits disclosed by the merchant.

4. Program Changes

To the extent permitted by law, we may change earning rates, reward thresholds, eligible purchases, expiration rules, or other program features. We may suspend or terminate the loyalty program after providing any notice required by applicable law.

5. Acceptable Use

You may not:

• Access or use the service unlawfully or fraudulently.
• Attempt to obtain points or rewards for ineligible purchases.
• Interfere with the application, terminals, servers, or networks.
• Attempt to bypass authentication or security protections.
• Reverse engineer or misuse the service except where permitted by law.

6. Availability

The service may occasionally be unavailable because of maintenance, internet interruptions, provider outages, terminal conditions, or other technical issues. We do not guarantee uninterrupted or error-free availability.

7. Suspension and Termination

We may suspend or terminate access, adjust a balance, or cancel a reward when reasonably necessary to address fraud, misuse, technical errors, duplicate awards, legal requirements, or violations of these terms.

8. Disclaimer

To the fullest extent permitted by law, Drum Circle Rewards is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

9. Limitation of Liability

To the fullest extent permitted by law, eYrthBeat will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of Drum Circle Rewards. Nothing in these terms excludes liability that cannot legally be excluded.

10. Third-Party Services

Drum Circle Rewards may interact with third-party services, including GoDaddy Poynt. GoDaddy Poynt and its affiliates are not parties to these Terms and are not the provider or licensor of Drum Circle Rewards.

11. Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where applicable law requires otherwise.

12. Changes to These Terms

We may revise these Terms periodically. Continued use after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
